New Hampshire has passed a new law requiring most shippers, receivers, warehouses, factories, distribution centers and other loading locations to allow truck drivers to use restrooms that are already available to employees or customers. Businesses will not be required to build new facilities, and access may still be denied when there is a legitimate health, safety or security concern.
The law also provides restroom protections for drayage drivers at ports and rail yards, including safe facilities, enough capacity to avoid long waits and a safe place to park while using them. Supporters say the measure is a basic matter of dignity, safety and respect for the drivers who keep freight moving. The law is expected to take effect in August 2026.
